 • ARTICLE 1 : ACCEPTANCE OF CURRENT GENERAL SALES CONDITIONS
Confirming an order made on the Planetrum website by an Internet user (clicking on the "Proceed" button) implies full and complete acceptance of all the present general sales conditions.
This contract is drawn up in accordance with French law. Full competence corresponds to the courts of the jurisdiction in which the Planetrum official headquarters are based (Pointe à Pitre – French West Indies).
• ARTICLE 2 : ORDERING
Once the buyer has placed an order, he is committed to the details given: the seller does not accept any responsibility for any errors in the delivery address provided, resulting in the non-delivery of goods.
Orders are not considered firm until the buyer has paid for them.
All our offers are only valid if there is stock available, without obligation and provided it has not been sold.
• ARTICLE 3 : DELIVERY AND RECEIPT
The Rums and Punchs are delivered in wooden cases or in cardboard boxes containing 1,2,3, or 6 bottles to be handed over in a single delivery at the same address.
Planetrum undertakes to deliver the goods in the shortest possible time. Average delivery times are detailed in product description, and may vary according to the country of destination selected by the customer.
Delivery will be made within the period forecasted directly to the address, or by means of notification if the client is absent.
Any possible delay does not give the buyer the right to cancel the sale, to reject the goods or to claim damages. Any delays resulting from war, uprisings, fire, strikes, accidents and the non-supplied products from the provider are considered to be due to circumstances outside one’s control, thereby releasing the seller from the obligation to make the delivery.
All liability for goods in transit corresponds to the address. Always check the packages on arrival. You have 48 hours to claim any damaged or missing goods from the shipping company.
• ARTICLE 4 : REJECTION OF GOODS
In accordance with the French consumer Code, the buyer has a period of 7 calendar days starting from the delivery date to return the goods to the seller, either for exchange or refund, at no cost other than return shipping costs.
• ARTICLE 5 : PRICES
Prices are given in EUROS and DOLLARS.
Prices given in product descriptions do not include transport costs.
The price given in the Planetrum order confirmation is the final price, with all taxes and including VAT if it is relevant. This price includes the cost of the goods, maintenance, packing and storing as well as shipping.
• ARTICLE 6 : PAYMENT
Goods may be paid for by credit card,cheque, Bank tranfers or safe payment by Paypal.In the case of payment by cheque, this should be issued in Euros, once the order has been accepted by Planetrum. An invoice will be issued and sent to the address given by the client for invoices.
The Rums and Punchs remain the property of Planetrum until all corresponding outstanding amounts have been paid.
• ARTICLE 7 : LAWSUITS
All complaints and claims will be carefully dealt with, taking into account that the client is acting in good faith, because he/she has taken his time to expose his/her claims.
In the event of a lawsuit, the client will first inform the company, in an attempt to reach an amicable solution. Should this prove impossible, sole competence corresponds to the Pointe à Pitre (F.W.I) Trading Courts, regardless of the agreed delivery destination and means of payment.
• ARTICLE 8 : LEGAL INFORMATION
Minors: In accordance with the French government ruling n°59-107 dated 7 January 1959 and the French law n°74-631 dated 5 July 1974, the sale of alcohol to young people under the age of 16 is forbidden. Anyone ordering rums or Punchs from Planetrum must therefore be at least 16 years of age and for (the Unites states 21 years of ages) as of the date the order is placed.
Alcohol abuse: alcohol abuse damages your health. Learn to drink and appreciate alcohol in moderation.
Information Technology and your rights: in accordance with the French law 78-17 dated 6 January 1978; you are entitled to access and alter your personal details. To do so, you have direct access to your personal on-line by using your Email ans password in checkout if had created an user profile before. All your personal information is for the exclusive use of Planetrum. Planetrum will not sell or rent out his clients addresses, e-mails or personal details.
• The alcohol abuse is dangerous for health. Be able to consume with moderation.
